Jurisdictional considerations in cross-border insolvencies

INSOL International is pleased to launch a new web based technical product titled “Jurisdictional Considerations in Cross-border Insolvencies”.  The project was led by Hugh Dickson, Managing Director, Recovery & Reorganisation, For Grant Thornton Specialist Services (Cayman) Limited.

Cross-border considerations are significant in international insolvencies, with the major offshore jurisdictions being a key component due to their involvement in large, complex groups and their central role in financial services structures and products.  

Offshore practitioners’ experience however is that onshore law firms and practitioners often lack experience and / or understanding of the offshore legal environment to make informed decisions when planning the approach to a major insolvency, and in the conduct of investigations, enforcement and recovery actions once an appointment has been made.

To that end, the objective of these off-shore country briefings is to provide practitioners about key information that will assist them to make informed decisions in their cross-border work. Each country chapter will have an introduction to the jurisdiction, which will provide enough information for an IP that is not familiar with that jurisdiction to get a basic understanding.  Further there will be chapters on the - legal process and infrastructure, antecedent transactions, cross-border recognition and related topics.

To begin with the countries covered are – Bermuda, British Virgin Islands and the Cayman Islands but we hope to expand this database.
